Early Case Assessment
Once a company reasonably anticipates a lawsuit, it has a duty to preserve all data related to the suit. Companies go through an exercise to identify, collect and preserve potentially relevant documents and files. Electronically stored information (ESI) that is collected for this purpose is then saved, often to an internal storage system that offers limited or no access to in-house or outside counsel other than an inventory listing what has been preserved. However such data has enormous value early in discovery prior to review, in assessing a case’s merits, potential liabilities, data volumes and associated costs.
