Court Ordered Production Site

Challenge

Courts may require that a defendant produce documents through a repository that is accessible to many parties; as might be the case for bankruptcy proceedings where many different firms represent the creditors. Cost must be managed carefully since all payments require court approval. Unlike a joint defense team where multiple parties cooperate, firms using the common production repository will likely be competing with each other to win the largest possible share of the corporate assets.
